This Notice is issued pursuant to the Personal Data Protection Act 2010 ("the Act") to regulate the collection and processing of your Personal Data by Tatler Solar, its subsidiaries, and affiliates.

1. Type of Personal Data Collected

Personal data may include but is not limited to name, NRIC/Passport number, correspondence address, gender, income range, contact details, bank account number, race, nationality, and utility bill history necessary for solar audits.

2. Consent

By providing your Personal Data to us, you have read and accepted this Notice and consented to the processing of data. If you provide third-party data (e.g., spouse/family), you warrant that you have obtained their consent.

3. Purpose of Collection

• Purchase of products and system installation.
• Engineering load profile analysis and site audits.
• Legal compliance and government regulatory filings (SEDA/TNB).
• Processing payments and financial record maintenance.

4. Disclosure of Data

You authorize disclosure to: Government agencies, local authorities, utility service providers (TNB), financial institutions, and professional advisers (auditors/lawyers) as deemed necessary for business operations.

5. Your Rights

You may exercise your right to access, rectify, or request the erasure of unlawfully processed data by submitting a request in writing to our data controller.

6. Transaction Security (SSL)

Refund Policy

Effective Date: February 2026

Project Cancellation

Solar installations involve specialized engineering and custom hardware procurement. Refunds are structured based on the project stage.

1. Technical Site Audit

If a technical site audit reveals that the premises are structurally or electrically unsuitable for the proposed system (e.g., roof integrity or grid capacity), a 100% refund of the deposit will be issued.

Note: A nominal site visit and administrative fee of RM 300 may be deducted for engineering costs.

2. Cancellation Post-Procurement

Once the Solar Purchase Agreement (SPA) is signed and hardware such as Deye Inverters or RW-L Lithium Batteries has been allocated or ordered:

Cancellations within 3 days of SPA signing: 70% refund of the deposit.
Cancellations after 3 days or once hardware is dispatched: The deposit is non-refundable to cover restocking, logistics, and allocation costs.

3. Authority & Processing Fees

Fees paid to third-party authorities, including TNB ATAP application fees, SEDA processing charges, or ST permits, are strictly non-refundable once the application has been submitted to the respective bodies.

4. Installed Systems & Defects

Once installation is complete, cash refunds are not applicable. Any component issues or performance concerns are governed by your Warranty Coverage:

5-Year Battery & Inverter Warranty for hardware repairs/replacements.
36-Month Workmanship Warranty for installation-related defects.

5. Refund Processing

Approved refunds will be credited via bank transfer to the original payor's account within 14 working days. Tatler Solar requires valid proof of payment to process any claims.

Usage Agreement

By accessing the Tatler Solar portal and ROI tools, you acknowledge that these terms govern all preliminary consultations and digital estimates.

1. ROI & Performance Disclaimer

Financial projections, "95% savings" claims, and BESS autonomy estimates (hours of backup) are simulated models for guidance only. Actual results vary based on:

TNB **Solar ATAP (2026)** quota availability and approval timelines.
Site-specific variables: roof shading, orientation, and ambient temperature.
BESS Usage: Battery backup duration depends on real-time load management and discharge depth (DoD).
Fluctuations in TNB tariff structures (ICP offsets) and government policy changes.

2. Quotation & Validity

Prices generated by the Online Calculator are preliminary estimates. A formal, binding Solar Purchase Agreement (SPA) will be issued only after a technical site audit. Digital estimates are valid for 14 days due to global supply chain and currency fluctuations.

3. Regulatory & Grid Requirements

Systems are designed to meet **SEDA** and **Suruhanjaya Tenaga (ST)** standards. Approval is subject to TNB's technical assessment of the local grid capacity. Customers must ensure the premises hold a valid **CCC/CFO** or equivalent legal occupation permit.

4. Limitation of Liability

Tatler Solar is not liable for indirect losses resulting from grid outages, TNB application rejections due to external quota limits, or equipment downtime caused by environmental factors beyond our control.

5. Intellectual Property

The proprietary ROI algorithms, Deye-specific optimization logic, and technical assets on this platform remain the exclusive property of Tatler Solar (TATLER ENERGY AND RESOURCES SDN BHD).
